Questions people ask
Is this agreement legally valid?
It is a general template for renting out a shop or office on leave and licence. Rules on stamp paper and registration differ from state to state, so for long or high-value agreements check with a lawyer or your local sub-registrar office.
Leave and licence or lease: which one is this?
This is a leave and licence agreement: the owner gives permission to use the premises for a fixed period, without creating a tenancy. Many shop and office rentals of 11 months or a few years are done this way. A lease creates a tenancy and usually has to be registered.
What is a lock-in period?
The months at the start during which neither side may end the agreement (except for a serious breach). It protects the owner from an early exit and the tenant from being asked to leave after setting up the shop.
Does a shop rent agreement need stamp paper or registration?
In many states leave and licence agreements are printed on stamp paper (or e-stamped) of the value set by the state, and agreements of 12 months or more often have to be registered. The value depends on the state, the rent, the deposit and the period.
What about GST on shop rent?
Rent for commercial property can attract GST when the owner is GST-registered. Write in the agreement whether the rent includes GST or is plus GST, and check with your accountant.
